National plan to end domestic violence

A Double Bay real estate agent has pleaded guilty to secretly filming himself and a girlfriend having sex, but the charges were dismissed on mental health grounds.

“You are the love of my life. You don't trust me,'” Jade Grech, 39, who worked for Highland Property real estate, texted the woman after she confronted him over the video he sent her via WhatsApp.

He also sent her a “face screaming in fear emoji”, Hornsby Local Court was told.

The girlfriend has told The Daily Telegraph that she was devastated that she was not told when his case was before the court. She expected to be called as a witness at his trial due to begin on Monday, September 26.

Instead she received a call from police only after Grech had changed his plea to guilty on September 16.

“For more than a year I was preparing myself to have my day in court, and to have that taken away without my input is not just disappointing, it makes me angry,” the woman, who cannot be identified, said.

“I feel totally let down and I don’t know the reasons the charges were dismissed.”

Grech pleaded guilty to intentionally recording an image without consent, and installing or using a device to record a conversation after the woman discovered he had also been secretly recording her in her car.

Magistrate Robyn Denes dismissed those charges on mental health grounds, which means no convictions were recorded.

She also dismissed charges of common assault and damage property on the same grounds after no pleas were entered.

The magistrate made Grech the subject of a two-year apprehended domestic violence order to protect the woman.

The court was told in an agreed statement of facts that the woman received the 1 minute 16 second video via WhatsApp from Grech in February last year.

She immediately replied: “Can you please ask me before you record these things?”

Grech sent her back a “face screaming in fear” emoji.

The woman replied: “I feel uneasy about it.”

Grech texted back: “You are the love of my life. You don‘t trust me.”

She replied: “I feel it’s a private thing with you and I.”

Grech replied with a crying emoji.

On March 8 last year, the woman woke up in Grech’s Macquarie Park apartment to find he had left. When she went to her car, she found he had washed and cleaned it. He told her he had not been able to sleep.

He had recorded himself on a USB saying: “3.15am on 8.3.2021 happy happy day.‘’

She returned to the apartment that evening and called police early the next morning after they had an argument. When he was arrested, police found in the pocket of his shorts her car keys and the USB containing other secretly recorded conversations, the court heard.

The woman told police in her statement that she had discovered Grech had made other intimate recordings of her, and voice recordings from when he worked in Dubai.

Magistrate Denes released Grech into the care of his psychologist.

A NSW Police spokesperson said they were investigating why the woman was not told in advance of the court date change.

Highland Property group real estate was advertising open houses with Grech following his court hearing, and he was still working for them two hours before they were contacted by The Daily Telegraph.

A spokeswoman said: “He has been stood down.”
