A court has refused to hand over documents detailing why a magistrate allowed an alleged rapist to walk free on bail, despite NSW Police and the Attorney-General taking steps to open a review into the decision.
It comes as police seized CCTV footage capturing the moments before and after Jason Williams, 35, allegedly raped a 56-year-old woman on a suburban Revesby street in the early hours of Sunday morning.
Williams was granted conditional bail in Bankstown Local Court on Monday on one count of sexual assault without consent.
But when The Daily Telegraph made an application to the court on Tuesday to view the Magistrate’s reasons for granting bail a day earlier, access to the documents was refused by the registry.
NSW Premier Dominic Perrottet said he had pushed for a review of the decision but defended the judiciary, saying they make the decision “in the majority of cases”.
“Our number one obligation is to keep people safe and that is clearly my focus as Premier,” Mr Perrottet said.
“I have spoken to both the police minister and the attorney general and there is a review that the Attorney-General has established in relation to these matters.
“The number one priority of the government is to keep people and the community safe, and that’s exactly what we will be doing going forward.
“Magistrates in the main get it right, let’s be fair.”
Mr Perrottet’s comments came after Police Minister David Elliott and opposition spokesperson Walt Secord voiced their outrage at the decision.
Because Williams was not charged with aggravated sexual assault, the matter did not reach the threshold where his lawyer was required to “show cause” as to why he should be granted bail.
In a statement, NSW Police confirmed steps had been taken to commence a review of the decision to grant Williams bail.
“Today (Tuesday, November 23 2021), prosecutors have submitted a report under Section 50 of the Bail Act to the Office of the Department of Public Prosecutions (ODPP) for consideration,” a spokesperson said.
Williams refused to comment on the incident when approached at his home, hurrying inside his apartment block despite an evacuation being in progress for a false fire alarm.
The CCTV seized by police shows a man walking with a woman along Marco Avenue about 12.05am on Sunday.
Some 30 minutes later the same woman can be seen hurrying back along the road.
Locals on the street who intervened in the alleged attack said they noticed a commotion on the front nature strip and when they went to investigate the woman allegedly claimed she was being raped.
“My brother’s mate came and parked the car right in front of the house there (on the street) and between the fence and the green car, he was sleeping on top of her,” Assaad Obeid, 32, said.
“He straight away called my brother and said: ‘Come and have a look, I think people are having sex in front of your house’.”
“My brother went nuts, he ran across to the fence, he grabbed him and ripped him off her.”
Police allege the men then chased after Williams as he tried to flee the scene and detained him until officers arrived.
After the alleged incident the woman is understood to have also run from the scene before police found her in a nearby park.
She was taken to Liverpool Hospital, where she underwent a Sexual Assault Investigation Kit.
Other women on the street said they were frightened to know such a shocking incident had allegedly occurred in the area.
