Beau Jae Carter escapes trial for horrific beating of ex-lover after he dies of unrelated causes

A woman accused of arranging for her ex-lover to be hogtied and bashed almost to death will not face charges because the man has since died of ­unrelated causes and can’t give evidence against her, a court heard.

Terry Boggs was tied up and ­beaten so badly inside his Central Coast townhouse on March 24, 2017, that he was lucky to survive.

He spent one month in hospital recovering from his injuries after police broke into his home and rescued him on March 25, 2017.

Inside, the officers found a person who barely resembled the 55-year-old Boggs, lying on the floor, struggling to breathe, with his head resting on an overturned bin.

He had been bashed with a hammer, and suffered punctured lungs and rib fractures. It took police 20 minutes to cut him free.

When the officers released Boggs, he said: “Thank God you are here. I thought I was going to die.”

The court heard one of the officers asked him: “Who did this to you?”. Boggs allegedly replied: “Jay … and Beauy.”

Prosecutors had alleged the second person was a reference to Beau Jae Carter, a one-time lover of Boggs.

She was charged with causing grievous bodily harm to Boggs and detaining him.

But prosecutors have since dropped those charges and Carter will face no further prosecution. This is because Boggs died of causes unrelated to the assault in October. Without Boggs as a witness, prosecutors concluded they had no case.

Carter’s lawyer Elias Matouk confirmed the charges were withdrawn on December 15.

Another man, Jason Thurgar, was jailed for a maximum nine years for the attack. No one other than Boggs could be considered reliable witnesses to give evidence.

The details of the case were outlined in a Crown case statement that was presented to Gosford District Court when the case against Carter was still being prosecuted.

From hospital, Boggs told officers he had a sexual relationship with Carter, where they had sex about 12 times over four or five years, the statement said.

He told the officers that on the day of the attack, Carter had come to his house with others “with a couple of casks of wine”.

Boggs told the officers that when he asked the group to leave, he was hit from behind with a hammer ­before being hogtied and having one of the attackers jump on his ribs, the document said.

Another person extinguished lit cigarettes by pushing them into his skin, the document said.

“While they were assaulting (Boggs) Carter was telling him that it was in retaliation for her being ­evicted from her house next door a year or two earlier,” the Crown case statement said.
