Waverley Council has joined forces with a Greens-backed legal fight against the rebuild of Allianz at Moore Park stadium in the Land and Environment Court.
Waverley will be the only council to enter into legal action on the Sydney Football Stadium demolition.
“This week Waverley Council joined the community group, Local Democracy Matters, in their legal proceedings in the Land and Environment Court,” Labor leader Michael Daley said in a statement.
Waverley Mayor John Wakefield told the Wentworth Courier he was concerned the rebuild of the stadium would cause problems for Bondi Junction.
“Moore Park is the main arterial road to access the Eastern Distributor and Southern part of the CBD and Western distributor,” Cr Wakefield told theWentworth Courier last month.
“We don’t know...how many square metres will be in the retail component.
“We don’t know the multiplier effects into Bondi Junction.”
Justice Pain has allowed the council to have its legal case heard at the same time as the Local Democracy Matters action.
The Sydney Cricket and Sports Ground Trust has argued the rebuild is based on safety issues with the stadium, including problems with exiting the site during an emergency.
In their motion, Waverley asks that the consent granted by the NSW Planning Minister for the demolition of the stadium be considered invalid and an injunction to stop any demolition of Sydney Football Stadium up to and including February 22.
The court hearing will run over three days from Wednesday (20 February).
Randwick, Woollahra, and City of Sydney councils have decided not push a legal case against the redevelopment.
The legal action is being taken against the State of NSW, Sydney Cricket and Sports Ground Trust, the Minister for Planning Anthony Roberts, and Lend Lease Building Pty Ltd.
Developers Lendlease has promised it will not proceed until after the court hearing.
Waverley Council has been named as a shareholder in the planning proposal of Sydney Football Stadium.
