A charity salesman who lashed out at a security guard trying to remove him from a popular Bondi pub due to his intoxication has apologised to a court.

A charity worker who drunkenly lashed out at security guards at a popular Bondi pub has been warned to moderate his drinking and behave himself by a magistrate.

Thomas Kurz, 25, was charged with common assault and failing to leave a premises when excluded after a drunken incident at the Beach Road Hotel in Bondi on February 26.

Documents tendered to Waverley Local Court reveal the Matraville man was asked to leave the pub after security observed him “limping” on the dancefloor, among other signs of intoxication.

“The accused was informed he was required to leave and he was offered the chance to quickly finish his beer before leaving but he remained and began to argue with security officers,” agreed police facts state.

“The manager has attempted to remove a beer cup from the accused and because of this the cup was crushed.”

Security officers then took hold of Kurz and attempted to escort him out of the pub before he lashed out.

“The accused flailed his arms around and leant his body back,” agreed police facts state.

“While the accused was being manoeuvred down the stairs, he leaned forward, wound his body, before throwing a left elbow strike backwards directed towards the victim.”

The security guard dodged the strike before pushing the victim’s head forward in self defence., and when police arrived at the scene they described Kurz as “argumentative and quarrelsome”. At Waverley Local Court, Kurz pleaded guilty to both offences and submitted a letter of apology through his solicitor.

Magistrate Anthony Spence sentenced Kurz to a 12-month conditional release order without conviction for the common assault and a $400 fine with conviction for refusing to leave the pub.

“Yung men end up at the night clubs and pubs and they think they can drink indefinitely,” Mr Spence said.

“Moderate your drinking, and behave yourself.”
