A scorned husband pelted his wife with eggs when his attempts to woo her back on what would have been their wedding anniversary were turned down.
James Lee Robinson, 50, of Bondi appeared in Waverley Local Court on Wednesday (May 12) charged with common assault, unlawful entry, using a carriage service to menace or harass and contravening the AVO his estranged wife of four years took out on him following the egging.
The police fact sheet states while the victim had originally agreed to meet Robinson, she changed her mind at the last minute.
She nevertheless arrived back at her Randwick home at lunchtime on February 28 to find Robinson inside with a bunch of flowers and bag of groceries insisting on making them both a meal.
The police document states despite being asked to leave repeatedly and the victim yelling out to her neighbours to call the police, Robinson didn’t go and instead began searching the house accusing her of hiding someone.
The victim eventually managed to lock Robinson out of her apartment and called police herself.
“Police attended and located the accused standing on the top floor. While speaking with police the accused stated that he had thrown eggs at the victim and that there had been an ‘egg fight’,” the police facts read.
“The victim’s head and torso were covered in egg and eggshells along with the floor and front door. The victim did not have any visible injuries however was very distraught and upset.”
Robinson was taken to Maroubra police station and, while in custody, was served with an AVO, the terms of which included not contacting the victim in any way.
However that didn’t stop him from sending her more than 100 messages via WhatsApp in less than a month, the court heard.
“You seek to control her,” Magistrate Carolyn Huntsman said in court.
“You’re on an order, right, a legal order which is required because you won’t leave her in peace.
“You still do what you want to do. Hundreds of texts, calling her a dog, calling her a c***. Abusive, disgusting, violent, threatening – all of it.”
The contents of the disturbing messages were revealed in court documents.
“You like moving the goal posts don’t you c*** where are they now f*** ya you low dog,” reads a message.
“Your not even a b**** because a dog knows its master wouldn’t just dumb him and let him go out in the cold on his god damn birthday (sic).”
The victim reported the messages to police on March 23 and Robinson was charged that evening.
Magistrate Huntsman sentenced Robinson to a supervised three year Community Corrections Order for the charges of common assault and contravening the AVO.
Under the order he must abstain from alcohol and drugs, accept a referral to a psychologist and comply with any treatment.
For using a carriage service to menace or harass, Robinson was sentenced to a three year Commonwealth Recognisance order under the same terms.
Robinson was also fined $400 for unlawful entry.
