An off-duty cop accused of punching a man before throwing his phone and later fleeing from officers has denied the allegations, a court has heard.

Deane Thomas Bell did not appear at Waverley Local Court on Wednesday where his matter was heard for the first time after being charged with assault and resisting police.

Police allege officers were called to Coogee Bay Rd, Coogee, after reports of an assault about midnight on April 14.

Eastern Beaches police arrived and were told a 31-year-old off-duty police officer had allegedly punched a 26-year-old man as he was exiting a taxi before throwing their phone and damaging it.

Police attempted to arrest the 31-year-old senior constable, however, he allegedly fled from officers which led to a short foot pursuit.

The man was arrested and taken to Maroubra police station where he was released.

He was later charged a month later on May 20.

Bell’s lawyer Ms Bulli said her client was pleading not guilty to the charges and asked Magistrate Jacqueline Milledge for him to be excused on the next occasion.

The court heard the brief of evidence will be served by the prosecution by August 23 with the matter stood over to the following month to fix a hearing date.

Bell’s employment status is currently under review.
