Adam Castucci jailed for 4 years for sexual intercourse without consent
A man has learnt his fate after raping a teenager who he also filmed topless and nearly passed out at a house party, with the words “jail bait” scrawled on her chest.

A man has learnt his fate over raping a teenage girl, who he also recorded topless and “barely conscious” on drugs, with the words “jail bait” written on her bare chest.
Waverley man Adam Castucci, 24, was sentenced in a Sydney District Court for two counts of sexual intercourse without consent, intentionally recording an intimate image without consent, and intentionally distributing an intimate image without consent.
A jury found Castucci guilty on the four charges following a trial earlier this year.
The horrifying allegations date back to December 2020, when Castucci met the 17-year-old girl at a house party in Sydney’s inner west.
On Friday, the court heard the teen had passed out on a couch after consuming wine, cannabis and GHB, which had her “seeing double, and unable to keep her eyes open”.
While she lay incapacitated on the couch, the teen’s top was pulled down and two men began sucking her breasts, and kissing her cheek.
One of the men used a marker to write the words “jailbait’ on her chest, the court heard.
Castucci recorded a 15-second video of the men sucking on the woman’s exposed chest, which he later sent to a friend before asking “will I get in trouble for that”.
In the hours following the house party, the teen woke in an unfamiliar bed to Castucci’s fingers inside her vagina. She then pushed his hand away and fell back asleep, the court heard
Sometime later, the teen woke again to Castucci kneeling on top of her about to put his penis inside her.
The court heard, the teen said “please don’t” before Castucci put his entire body weight on her and proceeded to have non-consensual intercourse with her for three minutes.
During a previous sentence hearing, the victim said she suffered night terrors and post traumatic stress as a result of being “violently violated”.
On Friday, Judge David Scully accepted the teen was in a “highly vulnerable state” and “barley conscious” at the house party, and accepted Castucci knew she wasn’t consenting to being filmed.
Judge Scully said he did not believe the victim was at this same level of intoxication when she was assaulted by Castucci the next morning.
In his sentencing remarks, Judge Scully accepted Castucci’s traumatic childhood had impacted his regulatory behaviour and executive dysfunction.
Castucci was sentenced to an aggregate sentence of seven years prison, with a non-parole period of four years and two months backdated to when he first entered custody in October 2024.
He will be eligible for parole in December 2028.
