Timothy Alfred Ngoma, 28, faced sentencing in Wagga Local Court on September 9, after pleading guilty to charges of common assault, break and enter and reckless grievous bodily harm.

Ngoma’s partner attempted to leave the unit when she was hit from behind, she then fled to a friends neighbouring unit where Ngoma broke down the wooden door and entered the property where four women were inside.

Court facts state Ngoma yelled obscenities at the women, yelling ‘you f****ing c***s,’ assaulted two of the women known to him before throwing a 40-year-old man onto a concrete path when he attempted to intervene.

The 40-year-old man suffered head injuries and was taken to Wagga Base Hospital before being flown to Canberra Hospital where he remained until April 29.

Agreed court facts state the man suffered a traumatic skull fracture, which left the victim with memory loss and requiring occupational therapy.

One of the female victims described the man as “going crazy” and “throwing punches at whoever he could get”, according to court documents.

Ngoma yelled “Call the cops, I don‘t give a f**k”, as one of the women at the property escaped via the backdoor of the property and alerted neighbours for assistance, while another climbed out of a bathroom window.

During the court proceedings, Ngoma’s lawyer, Mr Swain said his client had been diagnosed with schizophrenia in his early 20s and received monthly injections as treatment for the hallucinations and delusions that they suffer.

In sentencing, Judge Gordon Lerve noted that given their previous record and previous non-compliance with medication, he was unable to find the offender was unlikely to reoffend.

Judge Lerve did however note that Ngoma did show some positive signs of rehabilitation.

“The offender appears to be gaining some insight into the correlation between his substance use and mental health,” he said.

Ngoma, who has been in custody since April 23, 2020, and was sentenced to an aggregate sentence of four years and three months for the incident.

He will be eligible for parole on June 24, 2023.
