A woman accused of killing a 23-year-old man in a fatal crash on the NSW south coast last year is set to enter pleas following “unsuccessful” negotiations.

A woman accused of killing a young man in a horror NSW south coast crash last year is set to finally enter pleas more than a year since the tragic incident.

The allegations saw Michelle Anne Zutt, 46, first appear in Batemans Bay Local Court in July last year, charged with dangerous driving occasioning death and negligent driving occasioning death.

The Moruya woman is yet to enter pleas.

Police allege Zutt killed 23-year-old Jakob Peck in a tragic crash, after driving dangerously on Mossy Point Rd on the evening of July 4 last year.

Emergency services were called to the intersection of the Princes Hwy and Old Mossy Point Rd at Bimbimbie – 15km south of Batemans Bay – at 5.30pm following reports of a multi vehicle crash.

Officers attached to South Coast Police District attended and found Mr Peck, the driver of a hatchback, had died at the scene.

Zutt was treated by paramedics before being taken to the Moruya Hospital with minor injuries.

She was charged one month later following investigations.

The charges were mentioned again in Batemans Bay Local Court on Monday and while Zutt was initially set to enter pleas on this occasion, DPP representative Alison Dunne said this would no longer be the case following “unsuccessful” negotiations.

Despite this, Ms Dunne did reveal both parties were close to reaching a form of agreed facts, before noting the matter would be able to move forward at the next occasion.

Zutt’s lawyer, Philip Walton, wrote to the DPP before court on Monday, agreeing to an adjournment to allow final works on the agreed facts to take place.

Zutt’s matter will return to Batemans Bay Local Court on July 15.
