A south coast landscaper busted drink driving for the fourth time, told police he was trying to “get home slowly and safely”, despite still having alcohol in his system.

A south coast landscaper told police he was “trying to be a caring member of society and get home slowly and safely”, after being busted drink driving for the fourth time.

The offence saw Adam Limbrick, 36, sentenced in Batemans Bay Local Court on Monday after pleading guilty to mid range drink driving.

Documents tendered to the court state the Milton man – who was in Eurobodalla at the time – was driving his Subaru Forester along the Princes Hwy, Batemans Bay, on the morning of August 10 this year when he was pulled over for a random breath test.

Agreed facts state Limbrick admitted he drank alcohol the previous night, before he blew a positive reading of .086 – nearly two times the legal limit.

Limbrick was arrested and taken to the Batemans Bay Police Station, where he became extremely apologetic.

“I’m sorry for my actions,” agreed facts state he told police.

Limbrick told police he waited for the morning to drive home as he thought the alcohol would have left his system.

However, the Milton man refused to tell police how much alcohol he consumed the night before.

Limbrick was charged, issued a court attendance notice and had his licence suspended.

In court, Limbrick’s lawyer, Geoffrey Knox, said this was his client’s first drink driving offence in NSW, with the previous three occurring in QLD.

Mr Knox told the court his client was “trying to do the right thing”.

“Obviously, he just miscalculated the passing of alcohol through his body,” he said.

Mr Knox said his client was a hardworking landscaper who needed his licence for work.

“He’s very embarrassed to come before the court,” he said.

Magistrate Michael Love said drink driving of any kind was a serious offence.

“You had a big afternoon and night and tried to sleep it off, but it was still in your system,” he said.

“Your record does not assist you, but you have done the Traffic Offenders Program.”

Before sentencing, Mr Love said the 36-year-old man had good references and seemed genuinely remorseful.

Limbrick was convicted, fined $500, had his licence disqualified for three months. He will also have an interlock device installed for 12 months once his licence returns.
