A Lake Macquarie father, who got behind the wheel nearly three times over the legal limit with his 12-year-old son in the car, has lost his license for six months.
Brett Neil Talbot, 51, admitted to police on July 27 last year, he had drank in excess of seven bourbon and cokes when he was picked up by police around 5.30pm, just down the road from his Mirrabooka home.
“I didn’t have much food all day. I’ve only just finished a can a while ago, I’ve f****d up big time,” Mr Talbot said according to police facts.
Driving an unregistered car ehicle with his son in the front passenger seat, police facts said Mr Talbot seemed surprised that police were in the area. “What are you lot doing in this area?” he said.
Police facts also detailed how Mr Talbot got out of his vehicle and appeared unsteady, had a red face, smelt of intoxicating liquor and had slurred speech.
After a breath test, he returned a reading of 0.139.
Despite at first being arrested, police seized Mr Talbot’s keys that evening and allowed him to walk home with his son, which was only four houses away.
In Toronto Local Court on Tuesday, Mr Talbot pleaded guilty to drive whilst under the influence.
Magistrate Andrew Eckhold said it wasn’t an aggravated offence as he did not have an accident, but there was considerable risk.
“You were risking the child’s life as well as your own,” Mr Eckhold said.
“There is huge community concern around this and it is unacceptable.
“You have been dealt with before for a matter of that kind.”
Mr Talbot was given a 12-month community corrections order, six-month driving disqualification and a 24-month interlock order.
He was also issued fines for driving an unregistered and uninsured motor vehicle.
