A MAN fighting a $100 fine for destroying his neighbour’s property has faced court for his appeal wearing a colander on his head.

Keith Melvyn Wass, 53, of Blaxland, was charged with property damage in July 2018 for destroying a metal chain belonging to his neighbour.

He was found guilty and fined $100 in March.

Wass, who claims to be a “Pastafarian” — an adherent of the satirical Church of the Flying Spaghetti Monster — faced Penrith District Court on December 13 wearing a plastic strainer.

When Judge Mark Buscombe asked why he had a pasta strainer on his head, Wass said it was for religious reasons: “It is for religious observance, just as a Sikh would wear a turban or a Muslim would wear a hijab.”

A hearing for the appeal was delayed until next year after equipment used to record witness testimony did not work.

Mr Buscombe said witnesses would need to be recalled to give their evidence again.

The case will return to Penrith District Court on March 6.
