A court has heard charges are “most definitely pending” against federal MP Craig Kelly’s most trusted adviser as police prepare to speak to a new witness to an alleged incident involving a teenage girl.
Frank Zumbo has been under police investigation since April this year over his alleged conduct towards a girl who cannot be identified due to her age.
Details of the complaint have not been made public but have resulted in police obtaining a provisional apprehended violence order protecting the teenager from Zumbo.
Zumbo has vehemently denied any allegations of wrongdoing.
The former University of New South Wales business professor is a senior employee in Mr Kelly’s Sutherland electorate office.
At Sutherland Local Court police prosecutor Sergeant Walker told Magistrate Joy Boulos charges were “most definitely pending” against Zumbo.
“Charges are most definitely expected to be laid,” Sgt Walker told the court.
“A witness came forward just yesterday and she’s yet to be spoken to.”
Zumbo’s lawyer Michael Moussa reminded the court police were yet to lay charges five months down the track.
“The three statements which are the subject of the application, I’m instructed, were obtained around April this year,” Mr Moussa said.
“I would submit that the prosecution are seeking to delay the process when they have had ample time to investigate this particular application.”
Sgt Walker told the court police had no control over when witnesses came forward in this matter.
“I’ve told Mr Moussa I will instruct my officers to get their ducks in a line,” Sgt Walker said.
Mr Moussa advised the court he would make a Section 87 application pursuant to the Civil Procedure Act on the next occasion if charges had still not been laid by the next mention on October 14.
The application would seek to protect Zumbo’s position by removing his obligation to respond to the violence order application and potentially provide evidence to police in the alleged case against him before charges are potentially laid.
