Campsie barber Malek Hussein in court after allegedly having gun down his pants at Sydney park

A Campsie teen who was allegedly spotted with a pistol tucked in his pants outside a popular Sydney park and aquatic centre has been told by his lawyer to pipe down in court – or risk jeopardising his case.

A young Campsie barber who was allegedly seen leaving a popular Sydney aquatic centre with a gun tucked in his pants has been urged to pipe down or risk jeopardising his case, a court has heard.

Malek Hussein, 19, fronted Sutherland Local Court on Wednesday after being arrested and charged following an alleged incident outside Hurstville Aquatic Centre on Tuesday afternoon.

In court, the Campsie teen pleaded not guilty to possessing a prohibited pistol, but pleaded guilty to possessing prohibited drugs – namely meth and cannabis.

Hussein, the court heard, was allegedly spotted by a member of the public with a “gel blaster” tucked into the front of his pants as he left the centre with two other teenagers.

The witness alleged the gun could be seen above Hussein’s waistband as the group walked over to red vehicle in nearby Penshurst Park.

Police allege the trio then drove off before police stopped them on Forest Rd in Penshurst and searched the vehicle.

Hussein, who was allegedly a passenger in the vehicle, was allegedly found with 0.3g of meth and 0.9g of cannabis leaf.

The pistol, police allege, was discovered near the back seat of the vehicle where Hussein had reportedly been lying down to avoid sight.

A large sum of cash in $50 packets was also found, the court heard.

During Hussein’s bail application, the police prosecutor cited concerns about the accused posing a risk to community safety.

His defence lawyer submitted her client did “occasionally smoke weed” but had strong community ties, a clean record, and helped support his family through his work as a barber.

However, Magistrate Philip Stewart said the “connection to drugs and money” was cause for concern.

He also raised issue with the circumstances under which Hussein was allegedly seen with the pistol, as if it were “on display” to the public.

Noting his clean adult record, the magistrate did concede the 19-year-old had a “limited” juvenile record with fairly recent matters listed against him.

After Mr Stewart refused him bail, Hussein begun to repeatedly ask: “your Honour can I speak?”

The question prompted his lawyer to quickly try and cut him off.

“You shouldn’t say anything,” she shouted.

“Listen, you have pleaded not guilty to a very serious charge.”

Despite her efforts, Hussein continued to try and plead his case to the magistrate.

As he grew frustrated with his lawyer’s attempts to interrupt him once more he turned to her on the screen, telling her: “it’s my case, I know what I’m doing”.

The magistrate acknowledged Hussein had a “right to speak” but said the facts put before him were “troubling”.

After he was dismissed, Hussein could be heard in the background yelling: “he refused me bail, the f--king dog”.

The alleged driver of the vehicle, Zain Diab, 19, appeared before Sutherland Local Court later that day charged with driving on a suspended license.

Diab was granted bail with the condition not to take drugs unless prescribed by a doctor.

The third teenager has not been charged.

Hussein and Diab will return to court later this year.
