Sydney boy pleads guilty to knowingly displaying a Nazi symbol for the second time in three weeks

A Sydney teen has pleaded guilty to knowingly displaying a Nazi symbol for the second time in three weeks after an incident in one suburb.

A magistrate has been tasked with the daunting assignment of figuring out how to “protect the community” from one of the state’s most volatile juvenile offenders.

The 15-year-old boy has been charged 31 times and breached his bail conditions on 27 occasions with his latest crime spree seeing him scar a southern Sydney with hateful Nazi symbols and phrases as well as racial and homophobic slurs.

The boy appeared in Port Kembla Children’s Court on Tuesday where he pleaded guilty to damaging property and knowingly displaying a Nazi symbol without excuse.

Documents state the boy was with two NDIS workers about 5.30pm on October 22 when he used mulberries to mark trees along a Gymea street with swastikas.

A nearby resident started filming the boy who yelled “Heil Hitler” before they contacted police. Once officers arrived they witnessed a litany of depraved symbols, phrases and slurs branded onto the trees and pavement.

Documents state the list of phrases and slurs included “n----rs”, “heil mein Fuhrer”, “f----t”, “gas the Jews”, “Adolf”, “fascist Biden”, “Nazify Australia”, “666”, “9/11” and “1488”.

Police spoke to one resident who had their driveway defaced who told them the heavy mulberry stains could not be removed with soap and water.

Documents state the boy handed himself into police about six hours later before Children’s Court Magistrate David Williams denied him bail on October 23.

During the bail application, the court heard Mr Williams had sentenced the same teen three weeks prior for the same offence of knowingly displaying Nazi symbols.

The boy was sentenced to 12 months’ probation for two counts of knowingly displaying Nazi symbols, being armed with intent, intimidation, property damage, assault and contravening an apprehended violence order.

“He is very intelligent and speaks to me often on his own behalf,” Mr Williams said.

“He is at a loss to explain the behaviour that led to the probation orders – it has been said he does things to get a rise out of people.”

The boy has been diagnosed with autism, conduct disorder, and attention-deficit hyperactivity disorder, with other potential diagnoses still being explored.

On Tuesday, the court heard the boy had been assessed at Cobham Youth Centre and was recommended medication, however, he has “refused to take any”.

Mr Williams had the option to proceed to sentence, but adjourned the case for a children’s background report to be prepared.

“I can’t finalise this today, there has been too many offences,” Mr Williams said.

“I don’t know what to do, but I need to protect the community.”

Court documents state the most serious offences on the boy’s rap sheet included being armed with the intent to commit an indictable offence and creating an explosive device.

Bail was not applied though, though Mr Williams noted to the boy’s solicitor Stephanie Fowler there was “nothing that would likely get him bail”.

Mr Williams will hand down his sentence in November.
