A senior business executive allegedly assaulted a family member twice in one day before threatening to kill them if they called the police, a court has heard.
Sean Anthony Saliba, 56, fronted Sutherland Local Court on Monday after he was charged with two counts of common assault (domestic violence related) and two counts of intimidation (domestic violence related).
Police allege Saliba assaulted the victim at 10am and again at 3pm on Sunday, December 1 in Lugarno.
Police further allege Saliba threatened the victim twice that same day between 3pm and 7pm, before police arrested him in the early hours of Monday morning.
Saliba fronted court on Monday afternoon from behind bars where he made an application for bail.
The court heard there was an apprehended violence order in place against Saliba for the protection of the victim, however, police prosecutor Sergeant Josh Sanders said “(the AVO) doesn’t go far enough”.
Mr Sanders cited the risks posed to the victim if Saliba were to be released on bail, after he allegedly threatened: “Don’t you f--king call the cops, you wait and see, I’ll f--king kill you.”
Saliba shook his head and muttered “oh no” as Mr Saunders requested the court refuse his bail application.
However, a Legal Aid lawyer submitted it was Saliba’s first time in custody and the “weight of the situation had definitely caught his attention”.
“There has been a very serious eruption in the family … and there has been a major social shift in his world,” the lawyer said.
The court heard Saliba was a manager for lucrative import-export business Expeditors earning more than $20,000 per monthand would be able to forfeit a substantial self-surety.
Magistrate Imad Abdul-Karim accepted the submissions and granted Saliba bail, but not before asking him if he understood the proposed bail conditions, which included strict orders to comply with the AVO.
“Well if I breach bail I’ll be going to jail,” Saliba replied.
Saliba will return to Sutherland Local Court on December 4.
