A magistrate has described the night a southern Sydney woman struck a man in the testicles following a dance floor argument as “disastrous”.
Brianna Pearce, 24, was charged with common assault after a shocking incident at Cargo Bar near Sydney’s King St Wharf on November 18.
Agreed police facts tendered to Downing Centre Local Court reveal the Engadine woman was out with friends when she met the victim on the dancefloor alongside her co-accused and friend, 23-year-old Mikayla Reber.
“(There was) a brief conversation in relation to both parties’ friends kissing, the victim stated to (Reber) ‘fuck they’re into each other’,” the facts state.
“The victim and Reber were standing within 20cm of each other leaning into each other’s ear to talk, when Pearce has slapped the groin region of the victim in an upwards motion.”
The facts state the victim then said words to the effect of “you’re an idiot, you fat b---h” to Reber, at which point Reber is alleged to have punched the victim with both hands, using closed fists, about six times.
Reber has also been charged with common assault in relation to the incident and is yet to enter a plea ahead of her matter returning to court in January 2023.
“At no point in time did the victim give permission to Pearce to assault him,” police facts state.
“Pearce and Reber were escorted out of Cargo Bar by security via the upstairs exit and the victim was escorted outside via the front entrance.”
Police then arrived at the scene, and Pearce made full admissions as to her actions on bodyworn video.
They were then conveyed to Day St police station and charged.
Pearce faced Magistrate Megan Greenwood at Downing Centre Local Court on December 7, where she pleaded guilty to the single offence.
“What a disastrous night,” Ms Greenwood said on sentence.
Noting her unblemished criminal record and early plea, Ms Greenwood sentenced Pearce to a 12-month conditional release order without conviction.
