Blake Homann: Sans Souci real estate agent wins cocaine supply appeal

A spiralling drug, alcohol and gambling addiction during lockdown landed a Sydney real estate agent a community jail sentence over three drug charges. Now, he’s had a win in court.

Sydney was once Blake Homann’s playground.

But the fun and games boasted on the Sans Souci real estate agent’s Instagram profile came to a halt when he was caught red handed with 2.67g of cocaine and $1,300 cash while out in the CBD.

The 26-year-old succeeded in an appeal to reduce his sentence in the Downing Centre District Court for supplying a small quantity of a prohibited drug, possessing a prohibited drug and dealing with the proceeds of crime.

According to facts recited by Judge Alister Abidee, police were patrolling Kings Cross at 7:50pm in late April 2021 when they noticed Homann texting on his phone while looking around.

He was seen entering a Mazda 2, which appeared to loop around and then park nearby.

“The male was stopped by police where he admitted he had purchased four bags of cocaine,” Judge Abidee said, reading the facts.

“He told police he’d met up with a mate he hadn’t seen for a while and he had arranged via Snapchat to organise cocaine. It was 2.67g of cocaine.”

He was seen reaching down the front of his pants and they found 24 $50 notes and five $20 notes.”

The court heard Homann pleaded guilty to the three charges and was earlier sentenced in Sutherland Local Court to two nine-month prison terms to be served in the community.

Appealing that sentence in the district court on Tuesday, Homann’s defence lawyer Hayden Woolf submitted the penalty was too harsh because it did not cross the legal threshold that would require a jail sentence.

“In my view, that was completely disproportionate because it was only $1300,” Mr Woolf said.

“It was a single transaction, which he was committing to support his addiction.”

The court heard Homann held no prior criminal record, had not offended since the charges were laid and had engaged in rehabilitation for his drug and gambling addiction.

According to a psychologist report, Homann started smoking cannabis at age 16, gambling at age 18 and cocaine from about the age of 25. He had been diagnosed with ADHD, depression, anxiety and substance use disorder.

His mental health struggled in lockdown and he spiralled into heavier gambling, drug and alcohol use.

Judge Abadee took into account Homann’s mental health challenges and the fact the crown did not dispute the defence’s submission that a lesser penalty was appropriate.

Homann was sentenced to two 11-month community corrections orders starting May 24, subject to the conditions that he continue rehabilitation and psychological treatment and not use illicit drugs.

Judge Abadee accepted Homann had good rehabilitation prospects and held close ties with his family.

Homann is a real estate agent with Honer Dodd Realty in San Succi.

On his employer’s website, Homann is described as reliable, efficient and approachable.
