Rosebery: NSW Building Commission issues prohibition order on Jolyn Place units
A Sydney apartment complex built by fugitive developer Jean Nassif’s failed Toplace company has faced more drama with its second prohibition order in more than a year.

A Rosebery unit complex which fugitive developer Jean Nassif’s failed Toplace company built will no longer allow new residents to occupy the apartments after the building watchdog issued another prohibition order following serious defects.
It is the second such order for the Jolyn Place development at 67-77 Epsom Rd since November 2023 after serious defects including inadequate waterproofing works, fire safety and structural elements were uncovered.
The fresh prohibition order was issued to Toplace’s administrators dVT Group and restricts the issue of any further occupational certificates that would have allowed residents to move into dwellings of the 337-unit complex.
It will be in place until Fair Trading NSW revokes the order.
The occupation ban excludes the 13 retail shops on the ground floor of the development, which comprises 266 units and 71 serviced apartments.
In the order dated March 7, the NSW Building Commission warned dVT Group a breach of the order was a criminal offence.
The prohibition order was imposed after serious defects were identified in the building following Fair Trading inspections.
A fire safety defects report from October 2022 also identified serious defects in the building.
An individual or corporation – besides a council – that issues an occupation certificate will incur a $3000 or $11,000 penalty respectively.
The developer can appeal against the order in the Land and Environment Court within 30 days of the notice being issued.
Disgraced developer Mr Nassif operated Toplace before the company fell into liquidation in early 2023.
He fled to his homeland of Lebanon after being wanted by police for a string of alleged financial crimes related to his business dealings.
