A father from Sydney’s inner south has been released on bail after allegedly attacking another man with a knife in an unprovoked and drunken incident.
Father-of-two Mark Khoury, 42, had been drinking for about eight hours with two others at a Mascot home when the alleged attack unfolded about 2am on Saturday, October 24, a court has heard.
Police will allege when emergency services arrived at the Robey St home they found the alleged victim Bruce Ngawhare, 60, suffering from stab wounds to his lower back and thigh.
The alleged victim was taken to hospital but was released within 24 hours.
A court heard Khoury handed himself into police and was charged with one count of wound person with intent to cause grievous bodily harm.
Khoury has been in custody for a month and successfully applied for bail in Central Local Court on Tuesday.
The prosecutor opposed bail and alleged Khoury had stabbed the victim despite “no provocation”.
“Obviously alcohol is involved. He stabbed the victim a couple of times out of nowhere.”
However, Khoury’s lawyer claimed that none of his client’s DNA was found on the knife, following forensic testing.
“There is no forensic evidence that is going to link my client to this stabbing,” he said.
“My client is adamant he did not commit this offence.”
Khoury’s lawyer argued that the trio had been drinking together for a lengthy period and there was “a little more than drinking going on”.
He claimed the victim and witness were heavily intoxicated which could explain inaccurate claims being made.
Magistrate Margaret Quinn granted bail with strict conditions including his not going near Mascot, his residing at an address in Forest Lodge, and putting up a $20,000 surety.
Khoury was formerly living on Robey St in Mascot with his mother, the court heard.
His matter has been adjourned until next month. No plea has been entered.
