A man involved in a drunken night out in Coogee which ended after he broke a glass door trying to force his way into a bar and kicked a police officer while being arrested has been convicted and fined.
A man involved in a drunken night out in Coogee which ended after he broke a glass door trying to force his way into a bar and kicked a police officer while being arrested has been convicted and fined.
Jakob Lubrano, 23, from Cronulla, was sentenced at Waverley Local Court on Wednesday after pleading guilty to four charges relating to a drunken incident on the night of Saturday, July 6.
He was fined $880 and convicted over three of the charges but escaped conviction on the most serious charge of assault officer in execution of duty. He was also sentenced to a conditional release order for 12 months.
Police facts stated Mr Lubrano was drinking at the Coogee Bay Hotel and was asked to leave by security about 10.20pm because of the level of his intoxication. He had also been spotted by staff stealing green cordial from the bar.
He left the hotel and was denied entry at another licensed premises, Little Jack Horner. Eventually staff closed and locked the door to the premises after he continued to try and gain entry.
“The accused proceeded to shoulder barge the entrance doors with his left shoulder, causing the glass to shatter,” the police facts read.
He returned to the Coogee Bay Hotel and was refused entry before getting into an argument with security. A tussle began and he was restrained by security.
Police arrived and handcuffed him. Mr Lubrano threatened one of the officers, while he was being restrained on the ground, stating “if you were in my triangle I would f****** choke you out”.
He then “kicked out” as he was being moved to a police van and connected with an officer’s leg, the police facts said.
Mr Lubrano’s defence said the accused was extremely disappointed with himself and was shocked he said what he did to the officer.
“He would never have acted on those words your honour,” he said.
“He was astounded that he uttered those words and he accepts that his behaviour was unacceptable.”
He also said that the kick was more of a reaction to being taken away by police, rather than an attack on an officer.
The officer was not injured in the incident.
Mr Lubrano works as a support worker for people living with disabilities.
His other charges included destroy or damage property, excluded person re-enter/attempt to re-enter premises, and excluded person remain in vicinity of licenced premises.
