Kelly Borg: Maroubra woman sentenced over mid-range drink driving with kids in car

A Sydney woman was caught drink driving with three young kids in the car — and was on her way to get more alcohol when she was busted. She left court with no conviction.

When police inspected a car which had been parked half across a driving lane on a busy Sydney road creating traffic chaos, they found the keys still in the ignition and three young kids inside.

Soon enough, they saw 36-year-old Kelly Borg walk to the car from the neighbouring alcohol store, Matraville Cellars, having just bought several bottles of alcohol.

Waverley Local Court heard Borg told police she double parked on Bunnarong Rd because she “couldn’t find a park” before returning a positive result on a roadside breath test of 0.87.

The Maroubra woman received no criminal conviction.

According to agreed facts, Borg’s parking “significantly impacted the flow of traffic and created congestion as vehicles were forced to merge into a single lane”.

At Borg’s sentencing, Magistrate Ross Hudson said her licence had been suspended since the incident on July 17.

Magistrate Hudson read a letter from her husband in which he said his wife was embarrassed about her out of character behaviour, and the family had been through lots of turmoil over the past year.

“He mentioned shame, embarrassment, remorse and that she is a caring, compassionate and devoted mother,” Magistrate Hudson said.

“She is involved in a number of sports associations and volunteers in community”.

Magistrate Hudson said Ms Borg had seven matters on her criminal record, but these were not “any other massive offences” and included minor speeding offences.

He took into account the early guilty plea, the fact she had already been off the road for two months.

Magistrate Hudson chose not to convict Mr Borg of mid range drink driving or double parking, instead sentencing her to a two-year conditional release order.

Addressing Ms Borg, he said: “If you want to be so selfish … don’t ever put children in harm’s way”.

“Make sure this message rings in your ears as you leave court.”
