Justin Roberts applied for bail after allegedly stabbing his ex-partner on Newton St, Alexandria

A father who allegedly “callously” stabbed his ex-partner in the chest on an Alexandria street has made a bid for bail. Here’s what happened.

A Woolloomooloo father has unsuccessfully made a fresh bid to get out from behind bars after he allegedly stabbed his ex-partner in the chest at Alexandria.

Justin Roberts faced the Central Local Court on Monday via audio video link from custody where his release application was dismissed. He was charged with wounding a person causing grievous bodily harm.

The 31-year-old has not entered any pleas.

During the application, police prosecutor Sgt Sebastian Reay opposed bail being granted and described the Newton St, June 9 attack as “callous and blatant”.

“He (allegedly) stabbed his former partner in the torso while they were in public and the complainant had to be sent to hospital,” Sgt Reay said.

Police allege that after the incident, Roberts said: “Wait till I get you next time,” and visited the woman’s home.

Sgt Reay told the court that Roberts had a pattern of breaching AVOs over the past few years and the allegations had escalated to serious violence.

He said it was a strong prosecution case because the complainant knows Roberts, there are hospital records of the injury and a jail sentence would be “inevitable” if he is found guilty.

Roberts’ lawyer Brenna Maloney lodged the bail application on her client’s behalf and said the complainant did not report the incident to police until a month after it occurred.

Ms Maloney said while Roberts’ criminal record did not help the application, he had turned the corner over the past few years with just one conviction involving him being in possession of a knife.

“He is Aboriginal and has depression and anxiety which would make custody more onerous,” she argued.

Magistrate Jennifer Atkinson refused to grant Roberts bail and said the risks could not be addressed with the proposed conditions, especially with non-compliance to court orders and violence on his criminal history.

There was a strong need for the victim and the community to be protected, Magistrate Atkinson said.

The case has been adjourned to September 2.
