A drunk BMW driver who wrote off his luxury car and gained national infamy after crawling out of the wreckage and telling police “I should have ordered Uber Eats” has pleaded guilty to driving without his court ordered breathalyser.

Maroubra’s Timothy Dennis Deland-Cleveland, 31, went for the ill-fated food run at 1.30am on January 2, 2019.

He was convicted, disqualified from driving for one year, ordered to hold an interlock licence for 24 months after that period, and fined $500 after appearing in Waverley Local Court in September 2019 on a charge of high range drink driving.

Deland-Cleveland’s blood wasn’t drawn until two hours after the crash on Rainbow St in Coogee, which left his BMW 318i on its roof and damaged two parked cars to the tune of $10,000.

The Marourbra man will be sentenced next month.

Even then, it was still an eye watering 0.181, the court heard last year.

Now Deland-Cleveland is back before Waverley Local Court on a charge of not having the approved interlock device installed in his car.

The tattooed young man, who boasts an impressive piece of ink around neck which reads “My Brother’s Keeper” – a slogan made famous by the Bra Boys Gang, was not required to appear when his case was mentioned on Tuesday before Magistrate Carolyn Huntsman.

His lawyer submitted an email asking the sentencing be adjourned for two weeks until they obtained some material for the magistrate to consider.

He will next appear in court on November 10.
