A 20-year-old man facing serious break and enter and stalk/intimidate charges found himself back in court on Wednesday.

A young man facing serious break and enter and stalk/intimidate charges has been fined for using a stolen credit card.

Tyronne Richard Scaramella, 20, was arrested last week on a warrant after failing to appear at a court date earlier this year.

During the arrest, police discovered Scaramella had used an American Express credit card that didn’t belong to him to purchase cigarettes worth $56.

He was arrested in the same clothes he wore during the purchase.

Scaramella faced Magistrate Brian van Zuylen at Penrith Local Court on Wednesday and pleaded guilt to obtaining property by deception.

However, the prosecution was opposed to bail on charges of break and enter and stalk/intimidate, charges that Scaramella denies.

The prosecution cited Scaramella’s previous failure to appear as a risk, and said he had a criminal history that would “indicate continued offending”.

Scaramella’s lawyer said his failure to appear was due to being kicked out of his mother’s home, and said bail conditions could be applied to ameliorate any prosecution concerns.

She said he could live at a South Penrith address and report to Penrith police station with any frequency required.

She also pointed to his limited criminal history, and the fact he handed himself into police in March after being charged with stalk/intimidate.

Magistrate van Zuylen described Scaramella’s excuse for not appearing at court as “flimsy”, but granted conditional bail.

“The court is persuaded, given his limited record and denials of guilt, particularly in respect of stalk/intimidate, bail can be granted,” he said.

Scaramella must live at a South Penrith address, report to police once a week, and is banned from attending two addresses in Guildford and Blackett.

He was also fined $400.
