Penrith McDonald’s: Roy Haines sentenced for intimidation

A man has been banned from entering a western Sydney McDonald’s after he called a worker a “white piece of s***” and a “fat c***” during a tirade over his food order.

A man who threatened to bash a worker at a Penrith McDonald’s over the quality of his meal has been barred from entering the store for at least 18 months.

Roy Haines, 29, of Cambridge Park, pleaded guilty to a charge of stalk or intimidate with intent to cause fear in relation to the incident at the High St McDonald’s on June 14.

According to court documents, Haines made an order at the drive-through at about 9.30pm, but was unhappy with the quality of his food.

He began yelling and swearing at a worker, and later entered the store and demanded a new meal from Rixon Watts, saying the food was “chat”.

Mr Watts agreed to replace the food, but Haines demanded a drink despite the fact he hadn’t ordered or paid for one.

When Mr Watts denied Haines a drink, he said “It’s because I am black! I will pull you over the counter and bash you”.

He continued to abuse Watts, at one point calling him a “white piece of s***” before pulling out his phone and recording him, saying “does anyone know this fat c*** from Penrith McDonald’s”?

Watts took Haines’s phone and gave him the fresh food, prompting Haines to leave the restaurant. He returned shortly afterwards to request his phone back.

In Penrith Local Court on Thursday, Haines’s lawyer said he had a very limited criminal history, with only one previous conviction.

“There were issues in relation to drug use at the time of this offence,” she said.

“He’s trying to get his housing in order, and he’s open to the support of the community in assisting him with his rehabilitation.”

His lawyer requested to have the matter dealt with by a fine, however Magistrate Brian van Zuylen disagreed.

“He’s engaged in the most appalling threats and slurs to two young people at McDonald’s just serving people at the drive-through,” he said.

“The court has to consider imprisonment.”

Magistrate van Zuylen was convinced by a sentencing assessment report to sentence Haines to an 18-month CCO.

Haines must abstain from drugs, do 100 hours of community service, and must not go within 100 metres of the High St McDonald’s.
