A man who left his victim needing surgery for a haematoma will spend 15 months in jail with a nine-month non-parole period.

Corey James Turner, 27, who was living in Oxley Park at the time, left his victim with fractured orbital bones and bruising to the cheekbone after an unprovoked attack in Oxley Park in August last year.

Turner’s severity of sentence appeal was quashed by Judge Mark Buscombe in Penrith District Court on Friday afternoon.

According to court documents, Turner went to an address in Oxley Park on August 24 looking for an ex-girlfriend.

The tenant of the house heard a noise at the front door and found Turner standing in the doorway yelling “where is she?”.

Turner checked the bedrooms of the house before approaching a stand-alone unit in the backyard.

When Turner had left the house, the tenant noticed the door handle had been broken off the screen door, and there was damage to the door jamb.

Turner continued to yell as he approached the unit, and was pushed back out of the dwelling by the victim.

He punched the victim twice in the head before pinning him to a wall.

The victim was attacked by two dogs during the assault, and Turner continued to assault him after he was dragged to the ground.

Turner eventually left the property and the victim was taken to Nepean Hospital to undergo surgery on a large left-side haematoma and a fractured orbital bone.

Judge Buscombe described the incident as a “very significant assault”.

He said Turner was currently in a stable relationship, had a new two-week old daughter, and had undergone rehab in the time since his sentencing.

However, Judge Buscombe denied the appeal, saying that while he was conscious of the impact on both Turner’s family and new child, the unprovoked nature of the violence required punishment.

Turner will be eligible for parole in August, 2020.
