A man who allegedly choked a woman inside her western Sydney home before being charged with contravening a subsequent AVO three times will move further away from the complainant.
Stephen John Kallins, 32, of Cranebrook, applied to vary his bail before Magistrate Brian van Zuylen at Penrith Local Court on Tuesday more than a year after the incident in January, 2020.
According to court documents, police allege Mr Kallins choked and assaulted a woman inside a Jordan Springs home on the evening of January 28, 2020.
Mr Kallins has pleaded not guilty to charges of intentionally choking a person without consent and common assault in relation to the incident, and will face a hearing on April 28.
Furthermore, court documents reveal Mr Kallins has been charged with three counts of contravening a condition in an AVO in April and July last year.
He was originally bailed to an address in Cranebrook and was banned from going within 200m of a Jordan Springs address, a neighbouring suburb to the east of Cranebrook.
In court, Mr Kallins successfully varied his bail to live at an address in Penrith for “work reasons”.
An application to vary the existing AVO was rejected by Magistrate van Zuylen, who described the charges Mr Kallins was facing as “serious”.
The prosecution initially opposed the change of bail, and requested time to check Mr Kallins’s new address, but Magistrate van Zuylen granted the change, noting Mr Kallins had successfully varied his bail on Christmas Eve last year.
He will next appear at Penrith Local Court for a hearing on April 28.
