A man has been barred from going to a Penrith McDonald’s after police allege he threatened to bash an employee over a food order.
Roy Haines, 30, of Cambridge Park, was arrested on Tuesday relating to the alleged incident at Penrith’s High St McDonald’s on June 14.
He told Magistrate Brian van Zuylen he intended to fight a charge of stalk/intimidate with intent to cause fear of physical or mental harm during a bail application at Penrith Local Court on Wednesday.
According to police facts read to the court by Magistrate Brian van Zuylen, Haines was allegedly unhappy with an order he received at the drive-through.
He allegedly began to yell and swear at a staff member before leaving his car and entering the restaurant.
Staff member Rixon Watts agreed to replace Haines’s food, at which time he allegedly started complaining that he hadn’t received a drink despite not ordering one.
During the incident, police allege Haines said “It’s because I’m black, I’ll pull you over the counter and bash you” and called Watts a “white piece of s***”.
When police interviewed him, they allege he appeared to be “seriously affected by intoxicating substances”.
Magistrate van Zuylen said a warrant had been issued for Haines’s arrest after he failed to appear at his original court appearance on Tuesday, but acknowledged that Haines had handed himself in to police.
Haines’s lawyer said he was willing to live at an address in Kingswood, to not enter the McDonald’s on High St, and to report to police three times a week.
Magistrate van Zuylen granted bail, and also ordered Haines to forfeit $500 if he failed to appear at future court dates.
He will next appear in Penrith Local Court on August 27.
