A Katoomba Local Court magistrate on Monday issued a suppression order to protect the identities of two school-age female victims of alleged sexual assault.
A 49-year-old man appeared before the court on Monday morning charged with procure child for unlawful sexual activity, aggravated indecent assault – victim under authority of offender (two counts), and three counts of aggravated sexual touching of another person.
He has pled not guilty to all six charges.
“(A suppression order) will be appropriate for the protection of the victims,” Magistrate Fiona Gladys Toose told the court on Monday.
The Non Publication Order means that no identification of the alleged victims or alleged defendant is permitted.
According to the police fact sheet tendered to the court a high school teacher allegedly assaulted one of his former students on the school grounds in 2012. During this alleged assault he held the girl with both his hands and kissed her on the lips “in circumstances of aggravation”, the fact sheet said.
While he was working as a teacher, the defendant also allegedly indecently assaulted and had sexual activity with a female student, of or above the age of 14 years and under the age of 16 years, on several occasions between 2015 and 2019.
The police fact sheet states on one of those occasions he assaulted the girl and immediately after the assault “kissed her on the lips with open mouth while using his tongue in circumstances of aggravation”. In other incidents he allegedly sexually touched her on the breasts and on the buttocks without her consent.
The defendant will appear at Penrith Local Court on January 17, 2020.
Earlier this month, officers from Blue Mountains Police Area Command started an investigation after receiving reports a local high school teacher had sexually touched a student numerous times at her school.
Following extensive inquiries, investigators arrested a 49-year-old man at a home at Katoomba on November 8, 2019.
He was granted conditional bail to re-appear at Katoomba Local Court on Monday, where Magistrate Toose noted the matter should be heard in Penrith Local Court.
