A repeat drink driver was arrested during a struggle at a service station after he was busted drifting across multiple lanes on a major highway at over triple the legal limit.

Glenn Mouritz, 30, of Kingswood fronted Penrith Local Court after previously pleading guilty to driving with a high range PCA, refusing to submit to a breath test and resisting police.

Agreed facts state Mouritz caught police attention while driving down the Great Western Hwy just after 10:30 pm on February 2.

Police activated lights and sirens after the Jeep Wrangler, driven by Mouritz, was seen unable to stick in the middle of one lane – rather swerving from one into another.

Upon approaching Mouritz, after turning into a nearby 7/11, police observed he had red, glassy eyes, slurred speech with an intoxicating smell of liquor coming from the car.

When instructed to undergo a breath test Mouritz became “extremely argumentative”, refusing to answer if he’d been drinking and demanded extra time before providing a sample.

Observing empty beer bottles in the car, police informed Mourtizi if he didn’t comply he’d be arrested and taken to the police station.

In response, Mouritz began digging around in the glove box while refusing to say what he was searching for, prompting an officer to grab his arm to make him stop.

Police then forcefully pulled Mouritz from his vehicle and onto the ground while he kept resisting officer’s attempts to handcuff him by grabbing their wrists.

After a short struggle Mouritz was arrested and taken to Penrith Police Station where a breath test read 0.193 – over triple the legal limit.

On Thursday the court heard Mouritz didn’t remember arguing with police but recognises it was the wrong thing to do, his lawyer said.

“In terms of facts, clearly he doesn’t cover himself in glory, he drinks himself into a state where shouldn’t be in charge of any vehicle let alone one of that size, it’s just lucky he was the sole occupant,” his lawyer said.

The lawyer also tsaid Mouritz was suffering mental health issues but was “doing something about it.”

The court heard at the time of the offending Mouritz was on a community corrections order from a 2022 conviction of attempting to stalk/intimidate and also had a prior high range drink driving offence from 2017.

In sentencing Magistrate Fiona Toose instructed Mouritz to find a better way to deal with his demons suggesting he seek continued assistance from a psychologist, telling the court:

“If he’s got the money to buy the grog he’s got the money to pay for a psychologist.”

Glenn Mouritz was convicted and sentenced to an intensive corrections order for 12 months and had his license suspended for six months after which he must hold an interlock driver licence for two years.
