Former NSW Police officers Nathan Black and Timothy Trautsch admit assaulting mentally ill woman at Emu Plains

Two former NSW cops have pleaded guilty to assaulting a mentally ill woman, including spraying her genitalia with OC spray. Read the shocking details.

Two former NSW Police officers who laughed at a mentally ill, naked woman and used excessive force, including spraying her genitalia in western Sydney have pleaded guilty.

Former senior constables Timothy Trautsch, 30, and Nathan Black, 28, faced Penrith District Court after pleading guilty to assault occasioning actual bodily harm in company, possessing or using a prohibited weapon without a permit and common assault.

Black also pleaded guilty to two counts of intentionally publishing protected information.

The pair assaulted the 49-year-old mentally ill woman during a welfare check at Emu Plains in January 2023 while they were employed with the Nepean Police Area Command.

The pair responded to a call after a member of the public dialled triple-0 after noticing the victim naked in the street, bathing in puddles.

Black, who was a Senior Constable at the time, and Trautsch responded to the call while they patrolled the area in plain clothes.

The incident, which happened in the middle of a street, was recorded on officers’ body worn footage and CCTV from a nearby building.

The footage was played in court on Thursday, showing the woman, who is now deceased, sitting on the grass, swearing and threatening Black and Trautsch.

“If you touch me, you are f--ked. They’re up there watching,” the victim warns the pair.

“You dumb c--ts. They’re watching you …. you’re gonna be punished.

One of them had asked for her name multiple times and when she refused to answer, told her the ambulance was taking her to Nepean Hospital.

At one point, the woman tries to run and ends up defecating on Black’s leg and a scuffle is heard.

The footage later shows the victim on the ground, coughing with one officer grabbing wet wipes.

“I’m just wiping his leg cause you did a poo-poo on him,” Trautsch is heard saying on the footage.

They offered her some, with one of them telling her to “wash your stinky arse”. The woman instead chose to go to a puddle near a gutter, with one of them telling her “go on, wash your c--t, wash your arse.”

The court watched as the woman grabbed the cuffs, hearing a scuffle and the woman shrieking loudly.

At certain points in the footage, Black and Trautsch are heard laughing.

Documents tendered to the court reveal Black and Trautsch had deployed OC spray on the victim multiple times, including in her genitalia and back.

It also states Black had at one stage dragged the victim along the road by her hair, with the pair repeatedly kicking and stomping on her while she was on the ground.

Before using OC spray on her again, Trautsch warned Black there “could be cameras”.

The victim was eventually taken to the hospital, where the victim was treated.

Paramedics raised concerns over how the victim was treated, with medical staff asking Black if the victim had been “sprayed to her vagina”.

“Yes, you have to do what you have to do,” Black replied.

The documents also reveal Black had sent a 17-second video he had recorded on his phone to a colleague via Facebook.

Black told the colleague that they had emptied both OC “cans” onto the victim and further explained the incident the next day.

“She was f--ked the whole body worn is so good shows her being f--ked,” Black said.

“Nurses are lodging a complaint Jonesy is investigating because we caved her, but she had a hold of the cuffs and we had no other options.

“I’m like she bit us, bled her c--t on us, shat on us and wrestled in the rain on the road naked. Look my BWV (body worn video). Might not be uploaded yet. This is when she had my cuffs and almost had a full hold of them and we had no spray left.”

Once police were made aware of the incident, an investigation began and both officers were suspended from duty.

The crown prosecutor told the court the pair “chose violence” instead of other options.

“At all stages of this incident, the offenders were able to contain the victim,’’ he said.

“They may not have been able to put her under control, but they were fully able to contain her.

“There is no justification, no threat.”

The pair will return to court for sentencing.
