Parramatta: David Saies jailed for masturbating outside Macarthur Girls’ High School, touching child’s breast

A man who masturbated in front of a western Sydney all-girls high school also had a ‘grave impact’ on a child when he touched her breast. He has faced court for sentencing.

What happens when you are charged with a crime?

Just as school was wrapping up for the day, David Saies sat at a Parramatta bus stop and masturbated in front of students at Macarthur Girls’ High School in November.

The court heard two 17-year-old girls saw Saies exposing and touching himself with his hands near his genital area and his zipper down at the bus stop near the Thomas St zebra crossing on November 26 about 3.15pm when after-school pedestrian and road traffic was heavy.

After the girls alerted a witness about the flasher, she yelled at students to move away before the offender looked in her direction, zipped up his pants and then fled to a unit complex at Betts St where he was living.

Not even two weeks later, on December 6, he touched the clothed breast of a 12-year-old girl when she walked along Morton St, before she fled to the front yard of her home.

But the creep followed and opened the gate into the front yard of the unit complex

Saies then said “follow me home’’ before the victim rang the front doorbell and the offender ran towards Thomas St.

On December 7, cops arrested him in the driveway of his Betts St home when he declared to police that “the girls were asking him for it” and his “standards have dropped as he got older”.

During a police interview, he told detectives he believed “the child wanted his penis” before conceding he masturbated at the bus stop outside Macarthur Girls’ High School.

“The accused displayed concerning behaviour during the interview asking investigators if they could feel the ‘lust’ in the room,’’ the court papers state.

Saies appeared in custody via video link at Parramatta Local Court on Thursday when he was sentenced.

Mr Saies’ lawyer Wayne Russell told the court the offences were committed when Saies was on a community corrections order for assault on two strangers in September 2021.

“He accept what he did is criminally wrong and he accepts that his actions in relation to the young woman, when he touched her on the breast, could have long term problems for her,’’ he said.

He was charged with intentionally sexually touching a child between 10 and 16 and carrying out sexual acts with another person without consent.

In February, he pleaded guilty to the charges.

The court heard how Saies had a long criminal history that included 12 incidents targeting random members of the public, using prohibited drugs and “from time to time self medicated with cannabis’’ to treat his schizophrenia and damaging property.

He was a patient at Cumberland Hospital for four years but was not taking medication when he offended and court papers showed the offences were becoming more frequent and he was a “risk to society”.

Magistrate Kate Thompson told the court the 12-year-old girl’s victim impact statement showed Saies’ actions had a profound impact on her.

“It has a grave impact on her and her ability to engage with the world,’’ she said.

Police prosecutor Monique Welsh said his offences were aggravated after involving multiple victims and entailed a “degree of planning’’.

Magistrate Thompson took into account Saies’ pleas of guilty in February, his mental health problems and that he was in jail for the first time.

She sentenced him to 10 months in prison. He will be eligible for parole on September 12.
