Trevor Bistisi sentenced over Parramatta Chamber Cellars bottle shop fight

A magistrate has slammed a 52-year-old man who attacked a western Sydney bottle shop worker after they got into a scuffle when his partner was asked for ID.

A magistrate has reprimanded 52-year-old Trevor Bistisi for attacking a Parramatta bottle shop owner after he felt antagonised because he was told to “have a nice day’’ following a request for his partner to produce identification.

Bistisi fronted Parramatta Local Court on Monday after he pleaded guilty to assault occasioning actual bodily harm and stalking or intimidating intending to cause fear of physical or mental harm after the attack at the Chambers Cellars on February 15.

Police facts state Bistisi and his partner Madison Douglas got locked in a verbal stoush with worker Daniel Harrison when he requested she provide ID to confirm her age before she bought alcohol.

When they returned to the four-wheel drive, owned by Madison’s mother, the pair told the Victoria Rd shop employee to “f*** off” before he responded “have a nice day’’.

But the comment enraged Bistisi who stopped the car and stormed back into the shop while Madison stood at the entrance.

Police facts state: “The accused has said ‘What did you say? Do you want to take this outside?”

Mr Harrison followed Bistisi when he left the shop before they got in another verbal fight before Bistisi grabbed his shirt and pushed him backwards.

“The victim then drops the bottle and then places two hands around the neck of the accused and pushes him back, bending him backwards over a steel bollard,’’ police facts state.

The scuffle spilt into the store before Bistisi and Madison left.

Bistisi turned himself into Merrylands police station on March 2 where he admitting to “pushing the victim at the beginning of the incident due to the victim antagonising him, however, stated that he grabbed the victim’s neck due to observing the victim holding a beer bottle”.

“The accused stated the victim did not make any threats towards him while holding the bottle and acknowledged that on the CCTV footage, the victim did not raise the beer bottle.’’

Magistrate Kevin Hockey told Bistisi on Monday, that he should have just driven off instead of a tit-for-tat wrestling bout.

“You should know better than this,’’ he said.

“This is ridiculous. I’ve got no doubt the threat of the other person was smart, was probably provocative ... but it doesn’t excuse your actions.’’

Bistisi wrote a letter of apology and was handed a 12-month conditional release order with no conviction.
