A family feud over a car payment allegedly drove a man to stab - and eventually kill - his brother at Guildford, just days after that brother he had been released on parole following a jail sentence for a crash that killed his girlfriend.
Hussein Wraydeh, 47, was charged after the death of his 46-year-old brother Hassan, who was allegedly talking to a friend on the back veranda of the Rawson Rd house on Sunday, March 10, about 1.10pm.
Hassan had just been released from jail on March 2 after serving a sentence with a non-parole period of five years and three months over the crash that killed his partner Georgina “Gina” Abdallah at Punchbowl in August 2016.
He had caused the collision but instead of stopping to help his 38-year-old girlfriend, he wiped down his driver’s side door and left her behind with fatal injuries in the front passenger seat of their Mitsubishi Lancer.
Her brother Michael Leehman expressed a conflict of emotions after the “cowardly” man who claimed his sister’s life was now dead.
“The callous manner in which he abandoned her in her time of need will forever haunt us, a moment etched in our hearts when the police delivered the devastating news of her passing,’’ he said.
“Now, as news of Hassan Wraydeh’s own passing ... emerges, I am confronted with a complex array of emotions.’’
Hussein’s charges were upgraded to murder after his brother died at Westmead Hospital on March 13, three days after the alleged stabbing.
He was also charged with cause wounding/grievous bodily harm to person with intent to murder, contravening a prohibition/restriction in AVO (domestic) and using a prohibited weapon contrary to prohibition order.
His matter was mentioned briefly at Parramatta Local Court on Monday when he was excused from appearing physically.
Police fact sheets allege Hussein had not seen his brother for seven years when he went to the backyard of his house – which he was not supposed to visit under an apprehended domestic violence order for another person.
“The accused has arrived happy and has shaken the hands of all parties,’’ the fact sheets state.
But an argument over family and money allegedly erupted between the siblings when one friend left.
“The accused has begun complaining to the victim about all the issues he has with his family as well as money,’’ the police facts alleged.
“The accused has become agitated and angry and began yelling at the victim about his issues.’’
Police allege Hassan took exception to the accused involving his mother in the financial dispute, to which the accused agreed and said “I’m not getting Mum involved”.
Police also allege the men became enraged and “stood up to each others’ faces yelling at each other” when Hussein reached into his pocket and pulled out a 25cm gold flick knife with a 15m blade before he held it at his brother’s neck for 10 seconds.
A man in the yard tackled Hussein into several bins but he allegedly rose to his feet again to confront his brother with the knife, according to the police facts.
While the man pushed Hassan back again to foil the alleged stabbing, the accused has allegedly knifed the right side of his neck, and caused it to bleed profusely.
The police facts further state the man again tackled Hussein to the ground in an effort to disarm the knife from his left hand and wrestled with the accused for up to a minute before taking the weapon out of his hands and throwing it on the backyard shed’s roof.
Police allege another man covered a towel on the victim’s neck before Hussein grabbed it from him, rushed to his brother and said: “I am sorry, I am sorry. Call an ambulance.’’
Police allege he took several minutes to get a drink of water before rendering first aid.
They found several puddles of blood in the yard.
Hussein was taken to Auburn Hospital for minor injuries he endured while allegedly being disarmed and was discharged shortly after.
Hassan was taken to Westmead Hospital where he underwent surgery, was placed in an induced coma and suffered a stroke because of the injuries.
He was declared dead on March 13 just before 10am.
“The victim refutes the allegation that he was responsible for the injury,’’ police facts allege.
Outside court on Monday Hussein’s lawyer Mary Faiz said her client was devastated over his brother’s death.
“He’s burying his brother today so he’s obviously very devastated about that,’’ she said.
“He’s crying like there’s no tomorrow.’’
The case was adjourned to the same court on May 9.
