The moments a masked gunman leapt out of a parked car, before firing shots on a suburb street has been caught on tape.
Abdul Alameddine, 21, is standing trial in the NSW District Court over charges relating to a daylight shooting in November 2022.
He previously pleaded not guilty to discharging a firearm with intent to cause grievous bodily harm, firing a firearm in or near a public place, using an offensive weapon with intention to commit an indictable offence, and acquiring a pistol while subject to a firearms prohibition order.
Alameddine is being represented by solicitor Mostafa Daoudie, and high profile barrister Ertunc Ozen SC, who told the jury the gunman’s identity was the “critical issue”, which had to be proven by the Crown.
The Crown alleges Alameddine was the balaclava clad shooter who entered a Toyota HiLux parked on a suburban street in Lidcombe, and held a pistol to a man’s head who was sitting in the front seat.
One man, dressed in all black and armed with a silver pistol, got out before entering the stationary HiLux, where the intended target Gassan Haydar and his friend Mahdi Abdelmohsen were parked eating KFC.
A short time later the gunman exited the HiLux and fired in it’s direction, before re-entering the Corolla which fled the scene.
According to Mr Haydar the man held a pistol to his head and threatened to kill him, the jury heard during opening submissions last week.
Mr Haydar and Mr Abdelmohsen, who were both uninjured by the shot, then pursued the Corolla which they rear ended at a Homebush West intersection, nearby Rookwood Cemetery.
Footage of the significantly damaged Corolla after it was rear-ended, was played to the jury on Wednesday.
The occupants of both vehicles then descended into a brawl on the side of the road, which was recorded by nearby motorists and shown to the jury on Thursday.
Around the same time an anonymous caller to Auburn police station reported hearing “fireworks and yelling”.
Another witness later told police he’d been sitting on his front porch, when he heard “two or three banging noises” and someone screaming “I’ll f—king kill you”, the jury heard.
On Thursday, during cross examination as a Crown witness, Mr Abdelmohsen said at the time he wasn’t aware of any issues prompting him or Mr Haydar to be shot at.
“We were all close. The kind of problem to cause a shooter in the car, we would have known about it,” he said.
The trial continues.
