Troy Xerri: Brother of NRL star accused of killing woman in head-on crash in Eastwood court hears

An NRL star’s brother, who is accused of killing a woman in a head-on crash in Sydney’s north, did not appear in court today as police requested an extension to reconstruct the scene, a court has heard.

The brother of an NRL star who is accused of killing a woman in a head-on crash in Sydney’s north did not appear in court today as police requested an extension to reconstruct the scene, a court has heard.

Troy Anthony Xerri, 28, who is the brother of Cronulla Sharks player Bronson Xerri, was driving south along Blaxland Rd in Eastwood after 5pm on 10 November 2019 when he allegedly collided with a grey Mazda 2 killing a 63-year-old woman.

A third car with a 34-year-old woman driver who was also involved in the crash was taken to hospital.

Xerri, from Merrylands, was slapped with five dangerous driving offences including dangerous driving occasioning death, dangerous driving causing grievous bodily harm and negligent driving.

In court documents, police allege Xerri “failed to control his vehicle resulting in it crossing to the incorrect side of the road.” It further states another man and woman were also injured in the collision.

Xerri, who is on bail, did not appear at Burwood Local Court today for a mention on his case.

Police prosecutor Scheimer sought an extension of time so that police could shut down Blaxland Road for a reconstruction scene.

Ms Scheimer requested an adjournment to June 17.

Yet Xerri’s lawyer Khouzame told the court police have had “ample time” over the past 5.5 months and said the case will reach its six-month mark on May 13.

“Police had ample time… this is a very sensitive manner,” Mr Khouzame told the court.

When Magistrate Alison Viney asked when the reconstruction was to take place, the police prosecutor said she didn’t have a specific date yet.

Magistrate Viney told the court, “You understand a further adjournment is not going to be granted for this… You’ve been aware of the deadline for this matter for six months.”

She said no further extensions would be made unless the officer in charge was present next time.

When Ms Scheimer requested an adjournment to June 17, Mr Khouzame said eight weeks’ was “ample time” especially during the pandemic with reduced traffic.

The magistrate decided to adjourn the matter to June 10 before Mr Khouzame said he was not available on that date.

The matter was adjourned to June 17 for a brief of evidence to be served.

“I’ll note that the reconstruction is to be arranged," Magistrate Viney told the court.

"The prosecution’s extension of time is granted in the interest of justice.”
