Liquor giant Dan Murphy’s loses Land and Environment Court appeal to open a bottle shop in Mosman

The Land and Environment Court has rejected an appeal by Dan Murphy’s against the council’s decision to reject an application for the liquor giant to open a discount bottle shop in Mosman.

The 909 sq m store was planned for the ground floor of Marque Mosman on Military Rd, between Civic and Field lanes, and set for seven-day trading.

Commissioner Annelise Tuor said the traffic, parking and noise impacts on residents of the planned bottle shop were unreasonable.

APPLICATION FOR DAN MURPHY’S AT MOSMAN KNOCKED BACK

“The retail nature of Dan Murphy’s means that it is largely car dependent and consequently results in high traffic generation and demand for parking,” Ms Tuor told the court.

“The impacts on amenity are beyond the reasonable expectations established by the planning controls.”

The ruling backs the decision made by the Mosman Development Assessment Panel in June last year.

The panel said the store would potentially bring in more than 100 vehicles an hour to Mosman’s traffic-choked streets and create a parking nightmare.

Concerns were also raised about potentially restricting the access of fire trucks getting to and from Mosman Fire Station.

Residents lodged more than 70 objections with council citing traffic, garbage, pollution, noise and safety concerns.

Mosman Deputy Mayor Roy Bendall called the decision a “great victory for Mosman”.
