CPB Contractors fined $30,000 for unauthorised works on Warringah Freeway Upgrade project

The builder of Sydney’s newest motorway has copped a five-figure fine for carrying out unauthorised, noisy night work on the multibillion-dollar construction project.

CPB Contractors was handed the $30,000 infringement by the NSW Environment Protection Authority (EPA), which said the company had carried out the works on four consecutive nights in June, in breach of licence limits.

EPA director of operations Adam Gilligan said CPB Contractors undertook the works on sections of the Warringah Freeway Upgrade near homes at Crows Nest.

“This work caused disruption to nearby residents, leading to reports of poor and broken sleep,” Mr Gilligan said.

“Ongoing exposure to this level of noise at night is unacceptable and has been found to have lasting effects on people’s quality of life including an increase in stress and general anxiety.

“The licence conditions covering work on the upgrade are clear: noise limits from any night-time or evening work cannot be exceeded on more than two consecutive evenings — except with prior written approval – or on more than three evenings in a week.

“Construction work along the length of the upgrade is mostly occurring in high-density residential areas and these noise limits are in place specifically to safeguard the health and wellbeing of local communities.

“Compliance is not optional. It’s essential to protect human health.”

The fine follows homeowners petitioning the NSW Government for increased measures to address “unbearable” impacts of construction work on the project, which residents claimed had caused late-night noise, dust and vibrations impacts.

Many neighbours have formed a resident group called Cammeray Voices, which was set up to advocate for mitigation measures.

A spokeswoman for the group said some residents have moved out of the area due to noise impacts and disturbances including on weekends.

CPB Contractors was contracted by Transport for NSW to carry out the Warringah Freeway Upgrade, which forms part of the Western Harbour Tunnel upgrade linking the Rozelle Interchange to Sydney’s north shore.

The project incorporates road works from the north of Sydney Harbour Bridge to Willoughby Road in Naremburn.
