Shayne Wynne: Serial sexual abuser released into community after 12 years jail

A man with a significant history of sexual abuse and violence against women will be released from prison 12 years after he was sentenced for his heinous crimes.

A man jailed for 12 years for shocking rape and violent assaults has been released back in to the community, just months after he was charged for breaching his parole for a number of new assault offences.

Shayne Geoffrey Wynne, 51, was sentenced to 12 years jail in 2009 for three counts of assault occasioning actual bodily harm; three counts of common assault; and two counts of aggravated sexual intercourse without consent.

These offences were committed in August 2007 and October 2008, against two women while he was living in Port Macquarie.

Wynne’s history of repeated sexual violence also included acts of intimidation and threats to kill, including one violent episode when armed with a steak knife he told his victims: “I should have done this long ago. I’m going to kill you both.”

During this same event one of the women “begged” for him to stop, as he raped her.

“Shut up and stop acting like a victim,” he said, before an interaction with the second female in which he grabbed a rock and told her: “I‘m going to smash your skull.”

Wynne was sentenced by Judge Peter Garling on December 1 2008, who imposed a non-parole period of nine years jail which expired on November 2017.

He was released on parole, but was then charged again in June 2020 on a number of fresh matters when living in Liverpool, south west Sydney.

He was sentenced to four months imprisonment on five counts of common assault; one count of take or detain person with intent to commit a serious indictable offence; one count of assault occasioning actual bodily harm; one count of intentionally choke person without consent contrary; and one count of destroy or damage property.

He had been at Liverpool’s John Edmonson Club, where he threatened and assaulted a woman, before he held her hostage back in a house and said: “I already told you, you’re not f***ing going home; just sit there and shut the f**k up, you wonder why I hit you,” he said.

The woman was assaulted, repeatedly.

He had his parole revoked and he was sent back to custody. He had been serving time for his 2009 sentence at the Mid-North Coast correctional facility.

On November 25, 2020, Judge David Davies made orders subjecting Wynne to an interim detention order [IDO], and appointed two expert medical professionals to examine his suitability for release on an extended supervision order [ESO].

Dr Davis regarded the conditions of the ESO that were sought by the State as appropriate, and that the time should be five years in length.

“Given the circumscribed nature of Mr Wynne‘s risks, and the lengthy period of offending behaviour... one would have to see a period of stability of at least two-to-three years before his risk for violence and sexual offending could be considered anything other than high,” she said.

“Five years of stability would almost surely necessitate a reduction to moderate risk. However, this is highly dependent upon the status of recognised risk factors at the time, so I unfortunately cannot be very precise.”

On May 7 Supreme Court Judge Helen Wilson ordered that Wynne be placed on an ESO for a period of five years from May 11 2021.

He is to comply with a number of strict conditions set out in the order, including electronic monitoring and reporting to authorities. He will also have restricted travel, access to internet material and association with people. He must also comply with curfews, and necessary medical interventions and treatment.
