Police will be using telephone intercepts as part of their case against a man charged with bashing a stranger on a beach, a court has heard.
Syawash Morad Baigi, 19, of Lane Cove, is facing multiple charges after he allegedly punched a 26-year-old man who then fell and smashed his skull on rocks at Fairlight on January 10.
Manly Local Court has previously heard an argument over a homophobic slur and a plea for a cigarette led to man, 26, from North Narrabeen, suffering a near fatal brain injury.
The alleged victim ended up with a bleed on the brain, a fractured neck and had to endure emergency surgery involving a drill penetrating his skull after the alleged assault on the rock platform between Delwood and Fairlight beaches.
Mr Baigi, an apprentice who lives with his mother and brother, was arrested several days after the alleged assault, by later by Northern Beaches Detectives.
During a bail application hearing in January Manly Local Court heard that the accused was fishing with his brother and two friends close to where the alleged victim and his friends were having a Sunday afternoon drink.
The court heard that Mr Baigi approached the other group and asked for a cigarette.
Mr Baigi then asked if one of the men in the group was gay and then allegedly used the word “faggot”.
Mr Williams said that the accused yelled: “Come on guys, these guys are giving me cheek, let’s f*** them up.”
Mr Baigi then allegedly punched the alleged victim, sending him toppling over rocks into a small crevasse.
Baigi was charged with cause grievous bodily harm to person with intent; assault occasioning actual bodily harm and five counts of stalk/intimidate intend fear physical etc harm (personal). He is yet to enter a plea.
The Court heard on Wednesday that a brief of evidence against Mr Baigi was not yet complete and police were still waiting on telephone intercepts to be processed and included in the brief.
Mr Baigi did not apply for bail. The matter will be back in Manly Local Court on April 28.
