Mr Evans, 32, appeared via video link at Parramatta Local Court today, charged with assault occasioning actual bodily harm.

A fitness obsessive, Mr Evans has worked at a number of Sydney gyms and proudly displays his muscular body on his various social media accounts.

Police allege on Wednesday, May 13 officers from Northern Beaches Police Area Command attended Ramsey St following reports Rhys Evans was behaving erratically.

Police and paramedics attempted to negotiate with Mr Evans to enter an ambulance as he required medical assistance.
Five officers were required to assist ambulance staff but Mr Evans violently resisted.

While attempting to subdue him police allege Evans bit an officer on the shoulder while another suffered scratches.

The court was told Mr Evans takes a number of medications including anti depressants and anti-psychosis medication.

His lawyer argued bail could be granted as Evans has agreed to live with his mother Janis in Narrabeen, and could not be treated for his medical issues in custody.

But the prosecution said “police were not punching bags” and that Evans had knowingly bitten the police officer despite being HIV positive.

Police confirmed the officer who was allegedly bitten had undergone a test for HIV.

The court was told the medical results of the officer who was bitten have not come back.

Magistrate Kevin Hockey granted bail but with strict conditions including that Evans must live with his mother, obey a curfew and only leave the house for medical appointments with his mother.

He said while the alleged assault was serious Evans clearly suffered from mental health issues and was having a psychotic episode at the time.

Evans will next appear Manly Local Court on June 9.
