A disqualified and drunk driver who crashed into and critically injured a man using an ATM has been jailed for 18 months.
Paul David Bromhead, 59, of Allambie Heights, whose licence had been disqualified for five years in 2018 for high-range drink-driving, was behind the wheel when his car crushed Lachlan Moore against a wall at a neighbourhood shopping centre.
Manly Local Court has been told that Bromhead was also two times over the legal alcohol limit when his Skoda Octavia station wagon accelerated on to the foot path and pinned Mr Moore against the ATM at Allambie Heights on January 22.
Mr Moore, 20, of Allambie Heights, was using the cash machine to withdraw money for a takeaway meal for his family.
He suffered several leg fractures when the car mounted the kerb and trapped him against the wall of a bottle shop in Grigor Pl at about 7pm.
Police breath tested Bromhead, who said he had been drinking white wine. He blew 0.017.
The pensioner was convicted of dangerous driving occasioning grievous bodily harm and driving while disqualified. He was also convicted of driving an unregistered and uninsured car.
Witnesses told police the Skoda, which had been attempting to park with its front end to the kerb, lurched forward and struck Mr Moore as he used the Westpac ATM.
An agreed set of facts tendered to the court said: “As the accused drove forward into the car space, he accelerated harshly causing his vehicle to drive on to the concrete footpath.
“As a result, the vehicle impacted the victim who was standing at the ATM with his back facing the approaching vehicle driven by the accused.”
The facts sheet said Mr Moore was pinned by the car “before the vehicle rolled backwards, allowing the victim to fall to the ground.”
On Wednesday Magistrate Mark Richardson sentenced Bromhead to 18 months’ jail for the dangerous driving charge and set a non-parole period of 10 months.
Bromhead was also disqualified from driving for another three years and was fined a total of $1150.
Mr Bromhead, who has been in custody since his arrest, will be eligible for parole in November this year.
