Lachlan Foster: Freshwater man jailed for Manly kebab shop bashing

A man who brutally kicked, punched and stomped on a defenceless man following a ‘tosser’ slur outside a kebab shop has left court in handcuffs – and wont be tasting freedom for some time.

A man who brutally kicked, punched and stomped a defenceless man curled on the ground following a ‘tosser’ slur outside a kebab shop will spend at least 18 months behind bars over an attack he can’t even remember.

Lachlan Foster, 20, sighed heavily and rolled his hand through his hair once Judge Gordon Lerve sentenced the northern beaches man to two years and nine months jail, with a non-parole period of 18 months, for the drunken violence unleashed on a man in Manly in June last year.

The Freshwater man, supported in court by his parents, had previously told the District Court he had spent the night ‘gulping’ free booze at his boss’s birthday party and had a vague memory of bumping into the soon-to-be victim outside a Manly kebab shop.

A woman, after watching Foster toss his kebab wrapper to the ground, said “seriously, there is a bin right there”, leading to a running verbal battle as the two groups walked along Sydney Rd in the early hours of the morning.

Pushing and shoving erupted into a brawl outside a convenience shop with the victim knocked to the ground by a blow to the face by Foster’s friend.

The agreed statement of facts reveal Foster, then aged 18, “stood over” the victim and “raised his hand behind his head and punched him three times to the face and head area”.

He then forcefully kicked the defenceless man three times before completing the vicious attack with a right foot stomp to the head. The victim was rushed to Royal North Shore with serious facial fractures, spinal injuries and a broken left leg.

Judge Lerve found Foster to be genuinely remorseful and that the 20-year-old’s poor mental health and ADHD linked to the violent incident.

The Freshwater man had previously told the court he was ashamed by his actions and had given up alcohol.

Foster was convicted of reckless assault occasioning grievous bodily harm in company and sentenced to two years and nine months prison. He will be eligible for parole in April 2021.
