A man who worked at an exclusive Sydney private hospital has appeared in court for allegedly sexually assaulting one of its elderly patients.
Kieran Kibby, 49, of North Curl Curl, was charged with two counts of sexual intercourse without consent.
The alleged assaults on the elderly woman occurred in 2020 at the hospital on the northern beaches where Kibby worked as a wardsperson.
Mr Kibby was arrested by Northern Beaches Police and appeared in Manly Local Court on Thursday afternoon to apply for bail.
Police prosecutor Scott Williams said he had been instructed to oppose the accused’s bail bid.
Sgt Williams told the court that police had concerns that Mr Kibby may fail to attend future court proceedings if released from custody.
‘There is a strong likelihood of a custodial sentence if the accused is convicted,” he said.
Sgt Williams said there also concerns about the safety of the alleged victim and the community in general.
“This was a serious attack on a defenceless member of the community,” he said.
Mr Kibby’s solicitor, Ian Byrne, said his client worked as a wardsman and had been “in the industry for 30 years”.
Mr Byrne said his client did not have a police record, was not a flight risk and that his parents, as well as an aunt and uncle, were in court to support him.
Magistrate Bruce Williams said the police had alleged two “serious offences on an elderly person in an aged care facility”.
Mr Williams granted Mr Kibby strict conditional bail including conditions he continue to live with his parents, not enter the hospital or any aged care facility and must not approach or contact the alleged victim.
Mr Kibby must also surrender his passport..
As part of release, a $10,000 cash surety had to be lodged by an acceptable person. If Mr Kibby does not turn up for court, that money is forfeited.
Mr Kibby has yet to enter a plea.
The matter has been adjourned to Manly Local Court on April 8.
