Jesse Allan hit with upgraded charge over death of man after an alleged assault on The Corso, Manly

A man accused of allegedly assaulting another man on Manly Corso, leading to his death, has been hit with a new, more serious charge. See what happened in court

A man has been hit with an upgraded charge after the alleged victim of an early morning Sydney assault died in hospital 10 days after the incident.

Narraweena man Matthew Williams, 37, was found on The Corso in Manly just before 3am on January 27, suffering a serious head injury.

Bystanders performed CPR until emergency services arrived, with paramedics rushing him to Royal North Shore Hospital in a critical condition.

Police alleged that Mr Williams fell and hit his head on a wall and the ground during an incident involving Manly man, Jesse Allan, 24.

On January 28, Mr Allan was charged with one count of wound with intent to cause grievous bodily harm. He was granted bail in Manly Local Court on January 29.

Mr Williams, who had been placed in an induced coma, died last Tuesday night, February 6.

Manly court heard on Friday that Mr Allan’s original charge had been replaced with a new, more serious offence, — assault causing death.

During a bail review hearing on Friday, Magistrate Robyn Denes heard new details about the alleged assault.

The police prosecutor, in opposing bail, said Mr Allan, who had been drinking at a Manly hotel, allegedly sought out Mr Williams 30 minutes after the two had an initial verbal confrontation.

The court heard that there was no evidence of retaliation by Mr Williams towards Mr Allan and that CCTV footage allegedly shows Mr Allan push Mr Williams backwards. His head then hit a wall and the ground.

At the earlier bail hearing on January 29, a lawyer for Mr Allan said his client had allegedly used an “open handed push” in self defence during an altercation after words were exchanged between the two men.

On Friday the police prosecutor urged Magistrate Denes to revoke Mr Allan’s bail because he was a potential flight risk and had ties to the UK.

He also argued that Mr Allan had shown no insight into the seriousness of the alleged assault and was back drinking at the same hotel 12 hours after the incident.

Mr Allan’s barrister Daniel McMahon said the court could be assured that his client would not flee overseas.

Mr McMahon said Mr Allan had registered to attend a residential rehabilitation program at a clinic in the eastern suburbs.

Magistrate Denes continued Mr Allan’s bail, which included conditions that he continue living with his parents; not leave home without being with one of his parents; forfeit his Australian and UK passports and not to approach any international point of departure.

“This is a horrible situation for the family of the deceased and the family of the accused,” Ms Denes said.

Mr Allan, who is yet to enter a plea, will appear again at the Downing Centre Local Court on March 26.
