ICMS: Man, 20, charged with sex assault of fellow student at popular Manly business college

A night of whiskey and brandy shots led to a man at a prestigious Sydney business college allegedly sexually assaulting a fellow student in her room, Manly court has heard

A man who allegedly sexually assaulted a fellow live-in student at a prestigious business college in Sydney after they each had as many as eight shots of spirits, has been granted bail by Manly Local Court.

Jiahao (Jerry) Yang, 20, is charged with assaulting the woman in her student accommodation in the International College of Management Sydney (ICMS) at Manly.

The court was told on Wednesday that Mr Yang flew in from his native China in February to study English at the college, housed in the former St Patrick’s Catholic Seminary overlooking Manly Beach.

Mr Yang, now staying at Chatswood, has been charged with three counts of sexual intercourse without consent and one count of sexually touch another person with consent. He is yet to enter any pleas.

In an Affidavit tendered to court as an application for a court order for forensic procedures to be carried out on Mr Yang, police detailed the allegations against him.

Northern Beaches detectives alleged in the Affidavit that on March 19 Mr Yang and the woman had dinner in the meal room at ICMS between 6pm and 11pm.

During that time they each had between three to four shots of cognac and three to four shots of whiskey.

Due to the level of the woman’s intoxication, Mr Yang helped her back to her room where she allegedly said: “You can leave my room now. You can go.” before she vomited into a bin.

Police will allege that Mr Yang then took off the woman’s pyjamas before she said: “You can’t do this, we are friends.

“Only my boyfriend can do this”.

Police stated that Mr Yang then allegedly tried to kiss the woman, but she bit his lip. He then allegedly tried to have sex with her, but she struggled and kicked him away.

It was alleged that Mr Yang then digitally penetrated the woman before another woman knocked on the door and asked “Is she okay?”

Mr Yang allegedly replied: “Yeah, we’re fine. We are just playing”.

He then allegedly sexually assaulted the woman with his fingers again while she allegedly said “no, please no. Please don’t do this to me”.

Police stated in the Affidavit that the alleged victim had no more memory of the alleged assaults until she woke at 5am in pain and contacted the college’s Student Support Services. She was taken to Royal North Shore Hospital for examination.

It was alleged in the document that Mr Yang contacted the woman via social media and wrote “Last night I was really wrong” and “I’m sorry that I was really drunk. Can we end this privately?

“Don’t let the school kick me out.”

Police alleged that Mr Yang told college staff that the woman “wanted sexual intercourse”.

Magistrate Gareth Christofi granted Mr Yang strict conditional bail, including not to go within 100m of ICMS.

He adjourned the matters to the Downing Centre Local Court in Sydney for mention on June 1.
