Elizabeth Hawke: Manly woman charged with not wearing mask in Silo cafe and Infinity bakery

A woman who allegedly refused to wear a mask, or use a QR code, when she visited two Sydney eateries, is now before a Sydney court.

A woman allegedly refused to wear a Covid face mask when she visited popular northern beaches’ eateries, Manly Local Court heard on Tuesday.

Elizabeth Hawke, 59, of Manly, is also accused of refusing to use the mandatory QR, or “quick response”, code check-in procedure at the two venues.

Ms Hawke also allegedly did not comply with Covid health directions from police, including social distancing, while she was being arrested six days after she allegedly committed the face mask and check-in offences.

In documents tendered to court police alleged that between 9.53am and 9.55am on August 13, Ms Hawke did not wear a fitted face mask when she entered the Infinity Bakery in Market Pl, Manly.

Police also allege she failed to sign in, using the mandatory QR code, at the bakery.

Then, four minutes later, at 9.59am, Ms Hawke allegedly entered the Silo Espresso cafe on Sydney Rd, Manly, without a mask.

She also allegedly did not check in to that cafe using a QR code.

The QR code is designed to help NSW Health contact tracers alert people and businesses if a Covid-infected person has visited a premises.

There is no suggestion that Ms Hawke was Covid positive when she visited the cafe or bakery.

Ms Hawke was allegedly seen entering the bakery and the cafe without a face mask on by two off-duty police officers who reported the incidents to Manly police station.

At 3pm on August 13 police arrested her in Manly. They alleged that as they attempted to conduct the arrest, Ms Hawke “did refuse to socially distance and wear a face mask, whereby keeping 1.5m distance between her self and police”.

Trevor Hall, a solicitor for Ms Hawke, who was not in court, said his client was pleading not guilty to one count of not comply with noticed (Covid health) direction.

Mr Hall told the court that guilty pleas may be entered later on two counts of not wear fitted face covering in retail/business premises and two counts of fail to comply with electronic registration directive.

The matter is back before Manly Local Court on December 1.
