David Sutherland Tully, 35, of Avalon Beach, charged with attempting to murder by speargun, has been ordered to appear in a Sydney court.

The case of a man charged with trying to kill a man with a speargun during an altercation in a northern beaches street has been moved to the Sydney Downing Centre Local Court.
David Sutherland Tully, 35, of Avalon Beach, is charged with one count of attempt to murder and one count of cause grievous bodily harm.
Police allege Mr Tully shot John Dunne, 48, of Freshwater, with the speargun while the pair were having an argument outside a house in North Avalon Rd just before 5pm on August 2.
In Manly Local Court on Wednesday, Registrar Richard Harvey adjourned the matter for charge certification to the Downing Centre Local Court on December 3.
As part of the charge certification process a senior prosecutor will review the brief of evidence as soon as it is served on Mr Tully and confirm, or certify, the charges that will proceed.
Police allege Mr Tully fired the spear into Mr Dunne’s torso. The wound was just centimetres from his heart.
Mr Dunne, with the 1m spear protruding from his chest, managed to drive his car away from the house. Moments later he pulled over in nearby Coonanga Rd and asked members of the public for help.
After being stabilised by a CareFlight rescue helicopter medical team and Ambulance paramedics, Mr Dunne was flown to Royal North Shore Hospital with a section of the spear still in his chest.
No plea has been entered.
Mr Tully did not apply for bail and it was formally refused.
